DefenceWise Legal Notice Terms and Conditions of Trading
Definitions
"Client" means the organisation booking or paying for a Delegate.
"Delegate" means a person attending a DefenceWise training course.
"Charge" means the fee (if any) payable by the Client to DefenceWise in consideration of Defencewise providing the course or sub contracting the course to a third party .
"Course" means the open training course provided by DefenceWise and booked by the Client in accordance with these Terms.
"Location" means the venue at which the Course is to be held, further details of which are set out in on the DefenceWise website or such other location deemed appropriate.
"Terms" means this set of terms and conditions.
Race Relations Act 1976 as Amended and Equal Opportunities
DefenceWise takes its legal obligations under the Race Relations Act 1976 as amended to promote equality of opportunity and good race relations seriously. Each delegate will be expected to abide by the DefenceWise Equal Opportunity Policy at all times while at the Location and any behaviour which is deemed by DefenceWise in its absolute discretion to be a breach of that policy will result in that Delegate immediately being removed from the Course and the behaviour in question being reported to the Client.
Bookings
Bookings must be confirmed by the client on the DefenceWise Website. A commitment will be required from the client. This will take the form of either a valid purchase order or up-front payment. Once the above are received and processed, the booking will be confirmed by DefenceWise in writing. The number of delegates and their names must be given at the time of booking.
Prices & Payments
Some DefenceWise courses are chargeable to some or all clients. These are clearly marked in the corporate Course Portfolio. The Client will be notified of any charges at the time of booking and this will be confirmed in writing. Any relevant duties or taxes including VAT will be added to the cost of all sales at the prevailing rate. Where relevant, clients will be invoiced directly by DefenceWise and should render payment within 14 days to the address shown on the invoice.
Online products carry a two working day money back guarantee.
Cancellations
Whether or not a charge is to be levied for a DefenceWise course, cancellation fees will apply once DefenceWise has confirmed the booking. The fee is based upon the price of the course. Notice of cancellation must be made by letter or email. If the Client advises us of a cancellation or postponement more than 28 days before the planned start date, no charge will apply. After this date, the following sliding scale of charges will be applied:
Within 28 days of the course start date = 100% of course fee.
If a Delegate fails to attend a Course, and the Client will be charged the full fee for the Course.
Equipment & Belongings
The DefenceWise will not accept liability for loss of any equipment or other belongings. Delegates are responsible for the care of such items and should ensure these are secured adequately when left unattended. Delegates are responsible for the safekeeping and appropriate use of items loaned to them. Damage caused by inappropriate use or loss of such items will be charged to the delegate.
Health & Safety
Each delegate will be expected to abide by the DefenceWises Health & Safety Policy at all times while at the Location and any behaviour which is deemed a breach of that policy will result in that Delegate immediately being removed from the Course and the behaviour in question being reported to the Client.
Confidentiality & Data Security
Delegates should respect the security classification of any materials received whilst on any DefenceWise course and store them appropriately. Any personal data received by DefenceWise from delegates will be stored in accordance with its internal policy and the Data Protection Act.
Right to Dismiss
DefenceWise reserves the right, at its sole discretion, to send back to the Client, any delegate from any DefenceWise site on grounds of misconduct or upon failure of any mandatory section of any course.
Force Majeure
The provision of training may be totally or partially suspended by DefenceWise to the extent that delivery is prevented through any circumstance beyond its reasonable control. Defencewise will not be liable for costs incurred by the delegate.
Copyright
Defencewise retains its intellectual property rights to all of its materials, documents and software, none of which may be reproduced, modified, amended, stored in any retrieval system or transmitted, in any form or by any means, otherwise than for the purposes of the training course for which its use was intended, without the prior written permission of DefenceWise
